• "Service" refers to the Translatey Discord bot, website (translatey-bot.com), and all related features and functionality provided by Us.
• "Bot" refers to the Translatey Discord bot application that operates within Discord Servers.
• "We", "Us", "Our" refer to the operators and developers of the Service.
• "You", "Your", "User" refer to any individual or entity that accesses or uses the Service.
• "Server" refers to a Discord server where the Bot has been added.
• "Guild"refers to a Discord server. This term is used interchangeably with "Server" throughout these Terms.
• "Premium" refers to the paid subscription tier of the Service, managed and billed through Discord.
• "LibreTranslate" refers to the self-hosted open-source translation engine used to provide translations on the free tier of the Service.
• "DeepL" refers to the third-party translation API used to provide higher-quality translations on the Premium tier of the Service.

1. Acceptance of Terms

By accessing or using the Service, including the Bot and Our website, You agree to be bound by these Terms of Service ("Terms"). If You do not agree to these Terms, You must not use the Service.

2. Description of Service

The Service provides real-time message translation within Discord Servers. We offer a free tier powered by LibreTranslate and a Premium tier powered by DeepL with additional features and higher-quality translations.

3. Eligibility

You must be at least 13 years of age, or the minimum age required by Discord in Your jurisdiction, to use the Service. By using the Service, You represent and warrant that You meet this age requirement.

4. User Conduct

By using the Service, You agree not to:

• Use the Service to translate content that violates Discord's Terms of Service or Community Guidelines.
• Attempt to abuse, exploit, or circumvent rate limits or other usage restrictions imposed by the Service.
• Reverse-engineer, decompile, disassemble, or otherwise interfere with the Service's infrastructure or source code.
• Use automated tools or scripts to excessively or abusively interact with the Service.

5. Premium Subscriptions

Premium subscriptions are managed and billed entirely through Discord's payment system. All purchases, renewals, and cancellations of Premium are handled by Discord. We do not directly collect or process any payment information. Refund policies for Premium are governed by Discord's applicable terms and policies.

6. Data and Privacy

Your use of the Service is also governed by Our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, You consent to the collection and use of Your data as described therein.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT TRANSLATIONS WILL BE ACCURATE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICE, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY.

9. Termination

We reserve the right to suspend or terminate Your access to the Service at any time, with or without notice, for any reason, including but not limited to a violation of these Terms. You may discontinue Your use of the Service and delete Your account at any time through Our Account page.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Your continued use of the Service after any such changes constitutes Your acceptance of the revised Terms.
